NOTICE OF DISBARMENT AND RESTITUTION Case No. 11-93-GA Notice Issued: May 22, 2012 Timothy Kovach, P 39595, Ann Arbor, Michigan, by the Attorney Discipline Board Washtenaw County Hearing Panel #5.

1. Disbarred 2. Effective December 16,20141 Respondent filed an answer to the complaint after the Grievance Administrator had filed a notice of default. Respondent also filed a motion to set aside the default, which was granted by the hearing panel. However, respondent failed to appear at the hearing.

The hearing panel found that respondent failed to promptly payor deliver funds or property that a client or third person was entitled to receive, in violation of MRPC 1.15(b)(3); failed to hold property of a client orthird person in connection with a representation separate from a lawyer's own property, in violation of MRPC 1.15(d); failed to answer a request for investigation in conformity with MCR 9.113, in violation of MCR 9.1 04(A)(7); failed to respond to a lawful demand for information from a disciplinary authority, in violation of MRPC 8.1 (a)(2); engaged in conduct prejudicial to the

administration of justice, in violation of MCR 9.1 04(A)(1) and MRPC 8.4(c); engaged in conduct that exposes the legal profession or the courts to obloquy, contempt, censure, or reproach, in violation of MCR 9.1 04(A)(2); engaged in conduct that is contrary to justice, ethics, honesty, or good morals, in violation of MCR 9.104(A)(3); engaged in conduct that violates the standards or rules of professional responsibility adopted by the Supreme Court, in violation of MCR 9.1 04(A)(4); engaged in conduct that violates a criminal law of a state or of the United States, in violation of MCR 9.1 04(A)(5); violated or attempted to violate the Rules of Professional Conduct, contrary to

MRPC 8.4(a); engaged in conduct involving dishonesty, fraud, deceit, misrepresentation, or violation of the criminal law, where such conduct reflects adversely on the lawyer's honesty,

trustworthiness, or fitness as a lawyer, in violation of MRPC 8.4(b).

The hearing panel ordered that respondent be disbarred from th.e practice of law in Michigan, effective December 16, 2014, and that the disbarment period shall run consecutive to the disbarment which was ordered in Grievance Administrator v Timothy Kovach, Case No. 09-68­ GA. The panel also ordered that respondent pay restitution in the amount of $4,000.00. Total costs were assessed in the amount of $1,835.01.
