DISMISSAL Case No. 13-62-GA Scott F. Smith, P 28372, by the Attorney Discipline Board, affirming Tri-County Hearing Panel #68's order of dismissal.

1. Dismissal 2. Effective September 27,2014 Respondent was charged with various professional misconduct, including engaging in fraud and illegal conduct and counseling a client to engage in illegal or fraudulent conduct in connection with the purchase of respondent's residence, in violation of MCR 9.104(2)-(5).

The hearing panel found that the allegations in the formal complaint had not been proven by preponderance of the evidence and ordered Formal Complaint 13-62-GA be dismissed.

The Grievance Administrator filed a petition for review and the Attorney Discipline Board, after conducting review proceedings, affirmed the hearing panel's order of dismissal on February 25, 2015. The Grievance Administrator's subsequent motion for reconsideration was denied by the Board on June 17, 2015, and the Michigan Supreme Court denied the Grievance Administrator's application for leave to appeal on September 29, 2015. No costs were assessed against respondent.
