NOTICE OF SUSPENSION AND RESTITUTION Case No. 14-30-GA Notice Issued: August 6,2014

Richard J. Quist, P 19169, Grand Rapids, Michigan, by Attorney Discipline Board Kent County Hearing Panel #5.

1. Suspension - 180 Days 2. Effective August 1, 2014 1 Respondent did not appear at the hearing and was found to be in default for his failure to file an answer to the formal complaint. Based on respondent's default, the hearing panel found that respondent undertook the representation of a client that was or could have been materially limited by the lawyer's own interests, in violation of MRPC 1.7(b); entered into a business transaction with a client or knowingly acquired an ownership, possessory security, or other pecuniary interest adverse to a client without fully disclosing and transmitting the transaction terms in a manner that can be reasonably understood, without giving the client a reasonable opportunity to seek the advice of independent counsel, and without having the client consent in writing thereto, in violation of MRPC 1.8(a); and knowingly disobeyed an obligation under the rules of a tribunal, in violation of MRPC 3.4(c). The panel also found that respondent's conduct violated MRPC 8.4(a)-(b); and MCR 9.104(2)-(4).

The panel ordered that respondent's license to practice law in Michigan be suspended for 180 days and that he pay restitution. Costs were assessed in the amount of $1 ,696.76.
