NOTICE OF SUSPENSION (Pending Appeal)
Case No. 13-21-GA Notice Issued: January 21,2014 Shawn P. Davis, P 42546, Muskegon, Michigan, by the Attorney Discipline Board Muskegon County Hearing Panel #1.
1. Suspension - Two Years 2. Effective January 3, 2014 Respondent appeared at the hearing and filed an answer to the formal complaint in which he essentially admitted the misconduct alleged in the formal complaint. Specifically, respondent admitted that, in at least 22 matters, he failed to promptly notify a third person when funds in which a third person has an interest is received, in violation of MRPC 1.15(b)(1); failed to promptly payor deliver funds that a third person is entitled to receive, in violation of MRPC 1.15(b)(3); failed to hold property of client or third persons in connection with a representation separate from the lawyer's own property, in violation of MRPC 1.15(d); and failed to deposit legal fees and expenses that have been paid in advance in a client trust account until earned or expenses are incurred, in violation of MRPC 1.15(g). The panel further found that respondent violated MRPC 8.4(a) and (b) and MeR 9.104(2)-(4).
The panel ordered that respondent's license to practice law in Michigan be suspended for two years. The Grievance Administrator filed a petition for review and this matter will be scheduled for hearing before the Attorney Discipline Board.
