NOTICE OF SUSPENSION AND RESTITUTION WITH CONDITION Case No. 13-52-GA Notice Issued: January 8, 2014 Richard R Feeley, P 59570, Mt. Pleasant, Michigan, by the Attorney Discipline Board Tri­ Valley Hearing Panel #2.

1. Suspension - 180 Days 2. Effective January 3, 2014 Respondent did not appear at the public hearing and was found to be in default for failing to file an answer to Formal Complaint 13-52-GA. 8ased on respondent's default, the hearing panel found that respondent engaged in professional misconduct by neglecting his clients' legal matters, in violation of MRPC 1.1 (c); failed to seek the lawful objectives of his clients through means reasonably permitted by law, in violation of MRPC 1.2(a); failed to act with reasonable diligence and promptness, in violation of MRPC 1.3; failed to keep his clients reasonably informed about the status of their matters, in violation of MRPC 1.4(a); upon termination of representation, failed to refund any advance payment of fees that have not been earned, in violation of MRPC 1.16(d); upon termination of representation, failed to surrender papers and property to which the clients are entitled, in violation of MRPC 1.16(d); knowingly failed to respond to lawful demands for information from a disciplinary authority, in violation of MRPC 8.1 (a)(2); and failed to answer three requests for investigation, in violation of MCR 9.1 04(7) and MCR 9.113(A) and (8)(2). The panel also found that respondent violated MRPC 8.4(a)-(c) and MCR 9.104(1)-(4).

The hearing panel ordered that respondent's license to practice law in Michigan be suspended for 180 days and that he pay restitution in the aggregate amount of $4,549.00. The panel also ordered that respondent comply with a condition relevant to the established misconduct. Costs were assessed in the amount of $1,763.55.
