NOTICE OF TERMINATION OF INTERIM TRANSFER TO INACTIVE STATUS AND RETURN TO ACTIVE STATUS

Case No. 13-34-PI Notice Issued: February 12, 2014 Terry J. Nolan, P 39093, Muskegon, Michigan, by Attorney Discipline Board Kent County Hearing Panel #5.

1.

2.

Transfer to Active Status.

Effective February 6, 2014.

On March 7, 2013, the Grievance Administrator filed a petition to transfer respondent to inactive status, alleging that respondent was incapacitated to practice law by reason of an active dependency or addiction to cocaine and/or other controlled substances. After an initial hearing, the panel ordered that respondent's license to practice law in Michigan be transferred to inactive status on an interim basis, effective May 6, 2013, pending further order of the panel or the Board. The hearing panel's order allowed respondent to conclude one client matter under certain conditions

Additional evidence was received at hearing held on November 20,2013, and, on February 6, 2014, the hearing panel issued its report concluding that respondent was not incapacitated to practice law at that time. Contemporaneously with the report, the panel issued its order denying the Grievance Administrator's petition to transfer respondent to inactive status for an indefinite period.

Based on the panel's order and report, respondent's transfer to inactive status was terminated and he was returned to the active practice of law in Michigan, effective February 6, 2014.
