NOTICE OF REPRIMAND WITH CONDITION Case No. 13-59-RD Notice Issued: September 27,2013

Charles D. Septowski, P 34065, Round Rock, Texas, by the Attorney Discipline Board Tri-County Hearing Panel #16.

1. Reprimand 2. Effective September 26, 2013 In a reciprocal discipline proceeding under MCR 9.120(C), the Grievance Administrator filed a Petition for Order to Show Cause accompanied by a certified copy of the Agreed Judgment of Partially Probated Suspension, entered by the District 9 Grievance Committee Evidentiary Panel 9-4, State Bar of Texas, on March 12, 2013.

An order to show cause was served upon respondent on May 22, 2013, and respondent filed a delayed objection to the imposition of comparable discipline. The Attorney Discipline Board granted respondent's delayed objection and, on June 23, 2013, the Grievance Administrator filed

a response to respondent's objection. The matter was scheduled for hearing, during which the parties reached an agreement as to comparable discipline.

Based on the agreement of the parties, the hearing panel ordered that respondent be reprimanded for violating MRPC 4.4, MRPC 8.4(a) and MCR 9.104(9), and that the be reprimand conditioned upon respondent's successful completion of the partially probated suspension ordered in Commission for Lawyer Discipline v Charles D. Septowski, District 9 Grievance Committee Evidentiary Panel 9-4, State Bar of Texas, Case No. A0121114231. Costs were assessed in the amount of $1,707.11.
