NOTICE OF SUSPENSION AND RESTITUTION Case No. 12-123-GA Notice Issued: July 8, 2013

David B. Dunn, P 62773, Detroit, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #6.

1. Suspension - One Year 2. Effective July 6, 20131 Based on respondent's admissions and the testimony and evidence presented, the hearing panel found that respondent neglected a legal matter, in violation of MRPC 1.1 (c); failed to communicate, in violation of MRPC 1.4(a); failed to deposit advanced fees into a trust account, in violation of MRPC 1.15(d); failed to refund unearned fees upon being released from the representation of a client, in violation of MRPC 1.16(d); intentionally failed to respond to a lawful demand for information from a disciplinary authority, in violation of MRPC 8.1 (a)(2); and failed to answer a Request for Investigation, in violation of MCR 9.104(7) and MCR 9.113(A) and (B)(2). The panel also found that respondent violated MRPC 8.4(a) and (c); and MCR 9.104(1 )-(4).

The hearing panel ordered that respondent's license to practice law in Michigan be suspended for one year and that he should pay restitution in the amount of $900.00. Costs were assessed in the amount of $2,492.51.
