NOTICE OF SUSPENSION AND RESTITUTION Case No. 12-76-GA Notice Issued: May 9,2013

Damika L. Pace-Byrd, P 60446, Flint, Michigan, by the Attorney Discipline Board Genesee County Hearing Panel #3.

1. Suspension - 30 Days 2. Effective May 8, 2013 Respondent filed an answer to the formal complaint and appeared at the hearing. Based on the testimony and evidence submitted, the panel found that respondent, in her representation

of three clients, failed to act with reasonable diligence and promptness, in violation of MRPC 1.3; failed to keep her clients reasonably informed about the status of their matters and failed to promptly comply with reasonable requests for information, in violation of MRPC 1.4(a); failed to promptly payor deliver funds that her clients were entitled to receive, in violation of MRPC 1.15(b); and, upon termination of the representation, failed to refund to the clients advance payment that had not been earned, in violation of MRPC 1.16(d).

The panel ordered that respondent's license to practice law in Michigan be suspended for 30 days and that she pay restitution in the aggregate amount of $1 ,525.00. Costs were assessed in the amount of $2,442.79.
