Kenneth W. Hoesch, P 29525, Zeeland, Michigan, by the Attorney Discipline Board Muskegon County Hearing Panel #3. 1. Disbarred 2. Effective June 28,2013 Respondent did not appear at the hearing and was found to be in default for failing to respond to the order to show cause. Based on respondent's default, the hearing panel found that respondent committed the criminal offenses of mail fraud, in violation of 18 USC §1341; and making a false statement on an income tax return, in violation of 26 USC §7206(1). By engaging in conduct that violates a criminal law of the United States, respondent was also found to have violated MCR 9.104(5).
The hearing panel ordered that respondent be disbarred from the practice of law in Michigan and that he pay restitution in the aggregate amount of $1,507,172.19. Costs were assessed in the amount of $2,136.77.
