NOTICE OF DISBARMENT AND RESTITUTION Case No. 13-5-GA Notice Issued: June 13, 2013 Asad S. Farah, P 53900, Monroe, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #3. 1. Disbarred 2. Effective June 11, 20131 Respondent did not appear at the hearing and was found to be in default for failing to file an answer to the formal complaint. Based on respondent's default, the hearing panel found that respondent provided incompetent representation, in violation of MRPC 1.1; neglected his clients'

matters, in violation of MRPC 1.1 (c); failed to provide diligent representation to his clients, in violation of MRPC 1.3; failed to keep his clients reasonably informed about the status of their matters and comply promptly with their reasonable requests for information, in violation of MRPC 1.4(a); failed to explain a matter necessary to permit his clients to make informed decisions regarding their representation, in violation of MRPC 1.4(b); failed to timely refund an unearned fee to a client upon termination of the representation, in violation of MRPC 1.16(d); practiced law in a jurisdiction in violation of the regulation of the legal profession in that jurisdiction, contrary to MRPC 5.5(a); failed to notify a client in writing of his disqualification from the practice of law, in violation of MCR 9.119(A); failed to notify the court and the opposing party of the disqualification and failed to seek to withdraw, in violation of MCR 9.119(8); practiced law during the period of suspension, in violation of MCR 9.119(E)(1); held himself out as an attorney during a period of suspension, in

violation of MCR 9.119(E)(4); and failed to answer two requests for investigation served upon him by the Grievance Administrator, in violation of MCR 9.104(7) and MCR 9.113(A) and (B)(2).

Additionally, the panel found that respondent also violated MRPC 8.4(a)-(c); MCR 9.1 04(A)(1 )-(3).

The hearing panel ordered that respondent be disbarred from the practice of law in Michigan and that he pay restitution in the aggregate amount of $1 ,750.00. Costs were assessed in the amount of $1,752.55.
