NOTICE OF REINSTATEMENT WITH CONDITIONS Case No. 12-82-RP Notice Issued: March 13, 2013 Richard L. Banta, II, P 39845, Taylor, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #24.

1. Reinstated. 2. March 11,2013 Petitioner was suspended from the practice of law, by consent, for a period of 181 days effective September 3, 1998. His petition for reinstatement was granted by a hearing panel in October 2001, and he was reinstated to the practice of law on October 23, 2001. The Grievance

Administrator filed a petition for review and the Attorney Discipline Board vacated the hearing panel's order of reinstatement and ordered petitioner to cease and desist the practice of law effective April 16, 2002. New disciplinary proceedings were filed against respondent in May 2012, which resulted in a 180 day suspension, by consent, effective April 1, 2012.

On August 6, 2012, petitioner filed a petition for reinstatement in accordance with MCR 9.123(B) and MCR 9.124. Tri-County Hearing Panel #24, after concluding that petitioner had satisfactorily established his eligibility for reinstatement in accordance with those court rules, issued an order that petitioner was eligible for reinstatement upon his filing of proofs that he has been

recertified by the Board of Law Examiners and has paid his bar dues. The hearing panel also imposed additional conditions which will be effective upon petitioner's active reinstatement to the practice of law in Michigan.

The Board, after receiving written proofs that petitioner had been recertified by the Board of Law Examiners and had paid his bar dues to the State Bar of Michigan, issued an order reinstating petitioner to the practice of law in Michigan, with conditions, effective March 11, 2013. Total costs were assessed in the amount of $724.50.
