NOTICE OF DISBARMENT AND RESTITUTION (By Consent) Case Nos. 13-19-AI; 13-66-JC Notice Issued: July 31, 2013

Diane M. Hathaway, P 39999, Grosse Pointe Park, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #22.

1. Disbarred 2. Effective January 29, 20131 Respondent pleaded guilty to bank fraud, a felony, in the U.S. District Court, Eastern District of Michigan (Ann Arbor). In accordance with MCR 9.120(B)(1), respondent's license to practice law in Michigan was automatically suspended effective January 29, 2013, the date her plea was accepted.

The Grievance Administrator filed a notice of judgment of conviction on June 6,2013, and, on June 28, 2013, in accordance with MCR 9.115(F)(5), the parties filed a stipulation for consent

order of discipline, which was approved by the Attorney Grievance Commission and accepted by the hearing panel.

Based on the agreement of the parties, the hearing panel ordered that respondent be disbarred from the practice of law in Michigan, effective January 29, 2013, the date of her felony conviction. Respondent was also ordered to pay restitution in the amount of $90,000.00, and total costs were assessed in the amount of $750.00.
