NOTICE OF DISBARMENT AND RESTITUTION Case No. 13-57-GA Notice Issued: August 28, 2013
Michael H. Twiss, P 43422, Southfield, Michigan, by the Attorney Discipline Board TriĀ County Hearing Panel #65.
1 . Disbarment 2. Effective March 26,20131 Respondent did not appear at the hearing and was found to be in default for failing to file an answer to the formal complaint. Based on respondent's default, the hearing panel found that respondent neglected three legal matters, in violation of MRPC 1.1 (c); failed to act with reasonable diligence and promptness in dealing with three clients, in violation of MRPC 1.3; failed to keep three clients reasonably informed about the status of their matters and comply with reasonable requests for information, in violation of MRPC 1.4(a); and failed to return unearned attorney fees and other funds paid in advance to the client upon termination of the representation in two matters, in violation of MRPC 1.16(d). The panel further found that respondent had violated MCR 9.104(2) and (3).
The panel ordered that respondent be disbarred from the practice law in Michigan, retroactive to March 26, 2013, to run concurrent with the disbarment ordered in Grievance Administrator v Michael H. Twiss, Case No. 12-126-GA. Respondent was also ordered to pay restitution in the aggregate amount of $687.00. Costs were assessed in the amount of $1 ,659.00.
1 Respondent has been continuously suspended from the practice of law in Michigan since March 26, 2013. Please see Notice of Disbarment and Restitution issued March 26, 2013.
