1. Suspension - 220 Days 2. Effective January 6, 20131 The Grievance Administrator filed a petition for order to show cause on March 11, 2013, seeking additional discipline for respondent's failure to comply with the hearing panel's order of suspension and restitution (by consent), issued December 12,2012. Specifically, the Grievance Administrator alleged that respondent failed to pay restitution as ordered; practiced law while suspended; failed to notify his clients and the courts of his suspension from the practice of law, in violation of MCR 9.119(A) and (B); and failed to file a timely affidavit, in violation of MCR 9.119(C). Respondent filed a response to the petition and appeared at the show cause hearing held on June 18,2013.
Based upon the evidence presented at the hearing, the panel concluded that respondent had violated its December 12, 2012 order and ordered that respondent's suspension from the practice of law in Michigan be increased from 90 days to 220 days, effective January 6, 2013. The panel also ordered that respondent will not be eligible to petition for reinstatement until the previously ordered restitution of $10,850.00 has been paid in full. Costs were assessed in the amount of $1,977.62.
