NOTICE OF SUSPENSION AND RESTITUTION Case No. 10-90-GA Notice Issued: December 9,2010 Gregory A. Mikat, P 55735, Fenton, Michigan, by the Attorney Discipline Board Genesee County Hearing Panel #2.

1. Suspension - One Year 2. Effective January 7,20131 Respondent did not appear at the hearing and was found to be in default for failing to file an answerto the formal complaint. Based on respondent's default, the panel found that respondent neglected a legal matter; failed to seek the legal objectives of his client through reasonably available means; failed to act with reasonable diligence in the representation of a client; failed to explain a matter to the extent reasonably necessary to permit the client to make informed decisions regarding the representation; failed to withdraw and/or refund unearned fees; breached the confidences of a client; and failed to treat with courtesy and respect all persons involved in the legal process.

Respondent's conduct was in violation of MCR 9.1 04(A)(2) and (3); and Michigan Rules of Professional Conduct 1.1 (c); 1.2(a); 1.3; 1.4(a) and (b); 1.6(b); 1.16(d); 6.5(a); and 8.4(a).

The panel ordered the respondent's license to practice law in Michigan be suspended for one year, to be served consecutively with the three year suspension ordered in Grievance Administrator v Gregory A. Mikat, Case No. 09-56-GA. The panel also ordered that respondent pay restitution in the amount of $650.00, and assessed costs in the amount of $1,720.33.
