NOTICE OF SUSPENSION (By Consent)

Case Nos. 12-35-GA; 12-67 -GA Notice Issued: December 4,2012

Demetrio S. Timban, P 69420, Medford, New Jersey, by the Attorney Discipline Board Tri-County Hearing Panel #23.

1. Suspension - 175 Days 2. Effective November 30,2012 The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline, in accordance with MCR 9.115(F)(5). The stipulation was approved by the Attorney Grievance Commission and was accepted by the hearing panel. The stipulation contains respondent's plea of no contest to the allegations that he transmitted checks to opposing counsel in February 2010, representing payments from his client to the guardianship estate on behalf of a developmentally disabled person, in violation of MCl 750.131 [drawing on insufficient funds]; engaged in conduct that violates a criminal law, in violation of MCR 9.104(5); practiced law in a jurisdiction in violation of the legal profession in that jurisdiction, contrary to MRPC 5.5(a); violated

Michigan's Rules of Professional Conduct, contrary to MRPC 8.4(a) and MCR 9.104(4); and engaged in conduct that is prejudicial to the administration of justice, in violation of MRPC 8.4(c) and MCR 9.104(1).

The hearing panel ordered that respondent's license to practice law in Michigan be suspended for 175 days, commencing November 30,2012. Costs were assessed in the amount of $780.60.
