NOTICE OF SUSPENSION (By Consent)

Case No. 12-56-GA Notice Issued: November 29, 2012

David M. Foster, P 30041, Farmington Hills, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #70.

1. Suspension - 180 Days 2. Effective November 24,2012 The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline in accordance with MCR 9.115(F)(5) which was approved by the Attorney Grievance Commission and accepted by the hearing panel. Respondent pleaded no contest to the factual allegations contained in paragraphs 1-23, and pleaded no contest to the allegation that, in connection with his motion for leave to appear pro hac vice on behalf of a client in the United States District Court for the Northern District of Illinois, he knowingly made false statements of material

fact tot a tribunal or failed to correct false statements of material fact previously made to the tribunal, in violation of MRPC 3.3(a)(1).

Based upon the stipulation of the parties, the hearing panel ordered that respondent's license to practice law in Michigan be suspended for 180 days. Costs were assessed in the

amount of $961.30.
