NOTICE OF SUSPENSION WITH CONDITIONS Case No. 13-16-GA Notice Issued: May 24, 2013

Michael R. Josey, P 36364, Detroit, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #11.

1. Suspension - One Year 2. Effective December 31,20121 Respondent appeared at the hearing but was found to be in default for failing to file an answer to the formal complaint. Based on respondent's default, the hearing panel found that respondent held funds other than client or third person funds in a client trust account, in violation of MRPC 1.15(a)(3); failed to hold property of the clients or third persons in connection with a representation separately from the lawyer's own property, in violation of MRPC 1.15(d); deposited his own funds into a client trust account in excess of an amount reasonably necessary to pay financial institution service charges or fees or to obtain a waiver of service charges or fees, in

violation of MRPC 1.15(f); engaged in conduct in violation of the Rules of Professional Conduct, contrary to MRPC 8.4(a); engaged in conduct prejudicial to the administration of justice, in violation of MRPC 8.4(c) and MCR 9.104(1); engaged in conduct that exposes the legal profession or the courts to obloquy, contempt, censure, or reproach, in violation of MCR 9.104(2); and, engaged in conduct that is contrary to justice, ethics, honesty, or good morals, in violation of MCR 9.104(3).

The panel also found that respondent failed to answer three separate requests for investigation issued by the Grievance Administrator, in violation of MRPC 1.15A(f), MCR 9.104(7), and MCR 9.113(A) and (B)(2).

The panel ordered that respondent's license to practice law in Michigan be suspended for one year, to run consecutive to the 30-day suspension ordered in Grievance Administrator v Michael R. Josey, Case No. 11-122-JC. The panel further ordered that respondent be subject to conditions

relevant to the established misconduct. Costs were assessed in the amount of $1,715.97.
