NOTICE OF REPRIMAND WITH CONDITION Case No. 12-27 -GA Notice Issued: November 7,2012

1. Reprimand 2. Effective November 2, 2012 The respondent filed an answer to the formal complaint and appeared at the hearings. Based on respondent's admissions, the hearing panel found that respondent committed professional misconduct when, in his representation of a defendant against the charges of criminal . sexual conduct in the first degree, he subpoenaed the victim's medical and psychological records from an insurance company and a psychologist in preparation for a restitution hearing and a motion for a new trial. Respondent admitted that he requested those records be sent directly to him, rather than requesting an in camera inspection by the court, in violation of MCR 6.201 (C). The panel also determined that respondent's methods of obtaining evidence violated the legal rights of a third party, in violation of MRPC 4.4.

The panel ordered that respondent be reprimanded and be subject to a condition relevant to the established misconduct. Costs were assessed in the amount of $2,271.46.
