NOTICE OF SUSPENSION WITH CONDITIONS Case No. 12-87 -GA Notice Issued: December 11, 2012

Effective October 24, 20121 Respondent failed to appear at the hearing and, on October 17, 2012, the panel issued an order suspending respondent's license to practice law in Michigan, pursuant to MCR 9.115(H) and effective October 24, 2012.

Respondent appeared at a subsequent hearing, but was found to be in default for his failure to file an answer to the formal complaint. Based on respondent's default, the hearing panel found that respondent, as attorney of record for a client on a felony murder charge, also filed an

appearance as counsel for a second client charged with armed robbery, but who was also a named witness in the felony murder case which respondent was defending. Respondent was found to have engaged in a conflict of interest, in violation of MRPC 1.7(a) and (b); unlawfully interfered with an opposing party's access to information, in violation of MRPC 3.4(a); engaged in conduct prejudicial to the proper administration of justice, in violation of MRPC 8.4(c) and MCR 9.104(1);

engaged in conduct which exposes the legal profession or the courts to obloquy, contempt, censure, or reproach, in violation of MCR 9.1 04(a); and engaged in conduct that is contrary to justice, ethics, or good morals, in violation of MCR 9.104(3).

The hearing panel ordered that respondent's license to practice law in Michigan be suspended for 30 days, retroactive to October 24, 2012, the date of his interim suspension, and

be subject to conditions relevant to the established misconduct. Costs were assessed in the amount of ,072.10
