NOTICE OF SUSPENSION AND RESTITUTION (By Consent)

Case No. 13-64-GA Notice Issued: July 11, 2013 Nancy L. Dilley, P 34481, Grand Rapids, Michigan, by the Attorney Discipline Board Kent County Hearing Panel #1.

1. Suspension - 180 Days 2. Effective October 8,20121 The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline, in accordance with MCR 9.115(F)(5), which was approved by the Attorney Grievance Commission and accepted by the hearing panel. Contemporaneously with the filing of the formal complaint, the Grievance Administrator filed a Stipulation for Consent Order of Discipline, which contained respondent's plea of no contest to the allegations that she failed to promptly refund advanced fees to her clients after her license to practice law was suspended. Based on respondent's plea of no contest, the panel found that respondent failed to promptly refund advanced fees to her clients after her license to practice law was suspended, in violation of MRPC 1.16(d), MRPC 8.4(a) and MCR 9.104(2).

Based upon the stipulation of the parties, the hearing panel ordered that respondent's license to practice law in Michigan be suspended for 180 days, retroactive October 8, 2012, the date stipulated to by the parties. The panel also ordered that respondent pay restitution in the aggregate amount of $16,680.00. Costs were assessed in the amount of $769.53.
