FINAL NOTICE OF SUSPENSION Case No. 11-6-GA Notice Issued: June 1,2012

Paul J. Pemberton, P 18760, Beaverton, Michigan, by the Attorney Discipline Board, increasing Tri-Valley Hearing Panel #1's order of reprimand to a 30 day suspension, and modifying findings of misconduct.

1. Suspension - 30 Days 2. Effective June 1, 2012 The hearing panel found that respondent, while automatically suspended from the practice of law for his failure to pay bar dues, failed to file notices of disqualification with the courts, in violation of MCR 9.119(B); failed to file an affidavit of compliance with the Attorney Grievance Commission and the Attorney Discipline Board, in violation ofMCR 9.119(C); and appeared in court as an attorney while his license was suspended, in violation of MCR 9.119(0). The panel ordered that respondent be reprimanded.

The Grievance Administrator filed a petition for review. The Attorney Discipline Board, upon review, issued an order modifying the panel's order to include the finding that respondent's appearance in court while his license was suspended constituted the unauthorized practice of law, in violation of MRPC 5.5(a). The Board increased discipline from a reprimand to a 30 day suspension. Respondent filed an application for leave to appeal with the Supreme Court, which was denied on March 26, 2012. Respondent subsequently filed a motion to change the commencement date of suspension to June 1, 2012, which was granted by the Board. Total costs were assessed in the amount of $2,227.92.
