NOTICE OF REPRIMAND WITH CONDITION (By Consent)

Case No. 11-101-GA Notice Issued: January 30, 2012

Richard R. Scarfone, P 25797, Grosse Pointe, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #19.

1. Reprimand 2. Effective January 27, 2012. The respondent and the Grievance Administrator submitted a stipulation for consent order of discipline in accordance with MCR 9.115(F)(5). The stipulation was approved by the Attorney Grievance Commission and was accepted by the hearing panel. The stipulation contains respondent's admission that he failed to appropriately safeguard client funds by holding them after deposit in an IOLTA or non-IOLTA account, in violation of MRPC 1.15(d); and that he violated or attempted to violate the Michigan Rules of Professional Conduct, in violation of MRPC 8.4(a).

The Commission acknowledges that there was no evidence that client funds were misappropriated, or that respondent had a dishonest motive. Pursuant to the agreement of the parties, the hearing panel ordered that respondent be reprimanded and subject to a condition relevant to the admitted misconduct. Costs were assessed in the amount of $831.42.
