NOTICE OF SUSPENSION WITH CONDITIONS Case Nos. 11-69-JC; 11-70-GA Notice Issued: January 30, 2012

1. Suspension - 30 Days 2. Effective January 27, 2012 The respondent appeared at the hearing but was found to be in default for: his failure to file an answer to Formal Complaint 11-70-GA. Based on respondent's default and the fact that respondent's conviction in Case No. 11-69-JC was conclusively established by the 'filing of the judgment of sentence, the panel found that respondent had committed professional misconduct.

Specifically, he was found to have been convicted of operating while visibly impaired, second offense, a misdemeanor, in violation of MCl 257.625(3) and MCR 9. 10 4(A)(5); and, in a civil matter, respondent failed to provide competent representation, in violation of MRPC 1.1; brought a proceeding and asserted an issue therein that was frivolous, in violation of MRPC 3.1; violated to attempted to violation the Rules of Professional Conduct, in violation of MRPC 8.4(a); engaged in conduct prejudicial to the administration of justice, in violation of MCR 9.1 04(A)(1) and MRPC 8.4(c); engaged in conduct that exposes the legal profession or the courts to obloquy, contempt, . censure, or reproach, in violation of MCR 9.104(A)(2); and engaged in conduct that is contrary to justice, ethics, honesty, or good morals, in violation of MCR 9.1 04(A)(3).

Based on an agreement by the parties, the panel ordered that respondent's license to practice law in Michigan be suspended for 30 days with conditions relevant to the established misconduct. Cost were assessed in the amount of $1,871.78.
