DISMISSAL Case No. 11-43-GA Mark E. Webb, P 44688, Coldwater, Michigan, by the Attorney Discipline Board Kalamazoo County Hearing Panel #4.

1. Dismissal 2. Effective January 4,2012 Respondent, as Chief Assistant Prosecuting Attorney for the Branch County Prosecutor, was alleged to have made false statements of material fact to the 3-A District Court during a hearing in the matter of People v Alberta Osborne, 3-A District Court Case No. 2008-1289 FY, regarding the extent to which a representative of the Coldwater Community Schools had agreed to or accepted a proposed resolution of criminal charges against a school system employee. Respondent's conduct was alleged to be in violation of MCR 9.1 04(A)(1 )-(4); and Michigan Rules of Professional Conduct 3.3(c) and 8.4(a)-(c).

The panel unanimously found that the Grievance Administrator had failed to prove, by a preponderance of the evidence, that respondent was guilty of the misconduct as charged in the formal complaint. The panel dismissed the complaint and no costs were assessed.
