NOTICE OF SUSPENSION Case No. 09-77 -GA Notice Issued: December 20, 2011

David M. Stimpson, P 64583, Tecumseh, Michigan, by the Attorney Discipline Board, increasing Washtenaw County Hearing Panel #3's order of reprimand to a 30 day suspension.

1. Suspension - 30 Days 2. Effective December 17, 2011 The respondent filed an answer to the formal complaint and appeared at the hearing. The hearing panel found that respondent, in a divorce matter, failed to make reasonable efforts to correct a misunderstanding when he knew, or should have known, that an unrepresented person misunderstood respondent's role in the matter.

Respondent's conduct was in violation of MCR 9.104(A)(1)-(4); and Michigan Rules of Professional Conduct 4.3; and 8.4(a) and (c).

The hearing panel ordered that respondent be reprimanded. Both parties filed petitions for review and, on December 8, 2011, the Attorney Discipline Board issued its order and opinion increasing discipline from a reprimand to a suspension of respondent's license to practice law for 30 days. On December 14, 2011, the Board granted the parties' stipulation to change the effective date of suspension from January 6,2012, to December

17,2011. Total costs were assessed in the amount of $4,290.36.
