NOTICE OF SUSPENSION (By Consent)

David A. Pernick, P 55955, Novi, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #55. '

1. Suspension - 30 Days 2. Effective December 1, 2011 The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline, in accordance with MCR 9.115(F)(5). The stipulation was approved by the Attorney Grievance Commission and was accepted by the hearing. panel. The stipulation contains respondent's plea of no contest to the allegations that, in a bankruptcy matter, he engaged in a conflict of interest by representing a client when the representation of that client is directly adverse to another client; and engaged in a conflict of interest by representing a client when the representation is materially limited by the lawyer's own interest.

Respondent's conduct was in violation of MCR 9.1 04(A)(1 )-(4); and Michigan Rules of Professional Conduct 1.7(a) and (b); and 8.4(a) and (c).

Pursuant to the agreement of the parties, the hearing panel ordered that respondent's license to practice law in Michigan be suspended for 30 days, effective December 1, 2011. Costs were assessed in the amount of $925.79.
