David M. Burgess, P 58557, Detroit, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #11.

1. Suspension - 30 Days 2. Effective August 15,2011 The respondent and the Grievance Administrator submitted a stipulation for consent order of diSCipline in accordance with MCR 9.115(F)(5). The stipulation was approved by the Attorney Grievance Commission and was accepted by the hearing panel. The stipulation contains respondent's plea of no contest to the allegation that he was convicted, by plea agreement, of

operating a motor vehicle while under the influence of alcohol, third offense. The court took the plea under advisement and will reduce the charge, after November 15, 2011, to operating while impaired, second offense, upon respondent's successful completion of certain probationary terms.
