NOTICE OF REPRIMAND AND RESTITUTION (By Consent)

Case No. 11-30-GA Notice Issued: August 1, 2011

Thomas S. Hirsbrunner, P 66919, Lansing, Michigan, by the Attorney Discipline 80ard Ingham County Hearing Panel #2.

1 . Reprimand 2. Effective July 30, 2011 The respondent and the Grievance Administrator submitted a stipulation for consent order of discipline in accordance with MCR 9.115(F)(5). The stipulation was approved by the Attorney Grievance Commission and was accepted by the hearing panel. The stipulation contains respondent's plea of no contest to the allegations that he neglected a legal matter entrusted to him; failed to seek his client's lawful objectives; failed to act with reasonable diligence and promptness in representing his client; failed to explain the matter to his client to the extent reasonably necessary to permit his client to make informed decisions regarding the representation; failed to refund the unearned portion of a fee paid in advance of the representation; and failed to timely answer a request for investigation, in violation of MCR 9.1 04(A)(2)-(4) and (7); MCR 9.113(A); MCR 9.113(8)(3); and Michigan Rules of Professional Conduct 1.1 (c); 1.2(a); 1.3; 1.4(b); 1.16(d); and 8.4(a).

Pursuant to the agreement of the parties, the hearing panel ordered that respondent be reprimanded and ordered that he pay restitution in the amount of $3,500.00. Costs were assessed in the amount of $767.47.
