NOTICE OF SUSPENSION AND RESTITUTION Case No. 06-141- GA Notice Issued: May 16,2007 Eugene Ostrowe, P 24307, Walled Lake, Michigan, by the Attorney Discipline Board Tri- County Hearing Panel #82.

1. Suspension - 2 Years 2. Effective June 17, 201 1 The respondent failed to appear at the hearing and was found to be in default for his failure to file an answer to the formal complaint. Based on that default, the panel found that respondent, in a real estate matter, failed to take action on his client's behalf after accepting a retainer fee; failed to return his client's telephone calls or otherwise communicate with his client; and failed to return any of the $500.00 fee. In a civil matter, respondent failed to file a response to the other party's motion for summary disposition; failed to appear at the hearing on the motion; and failed to withdraw or attempt to withdraw from his representation. Finally, respondent failed to answer a request for investigation served upon him by the Grievance Administrator.

Respondent's conduct was in violation of MCR 9.104(A)(I )-(4) and (7); MCR 9.1 13(A); MCR 9.1 13(B)(2); and Michigan Rules of Professional Conduct I.I( c); 1.3; 1.4(a); 1.16(d); 8. I( a)(2); and 8.4(a) and (c). The hearing panel ordered that respondent's license to practice in Michigan be suspended for two years, and that the suspension run consecutively with the order of revocation issued on June 22,2006 in Grievance Administrator v Euaene Ostrowe, Case No. 06-21- MZ (Ref. 05-89-MZ; 04-15 4-GA). Respondent was also ordered to pay $500.00 in restitution and $1,753.37 in costs.
