NOTICE VACATING NOTICE OF SUSPENSION NUNC PRO TUNC [Pending Appeal]

Case No. 09-47-GA Notice Issued: June 16, 2011

Michael L. Stefani, P 20938, Royal Oak, Michigan. The hearing panel found that respondent knowingly disobeyed an obligation under the rules of a tribunal, in violation of Michigan Rules of Professional Conduct 3.4(c). The panel ordered that respondent be reprimanded.

The Grievance Administrator filed a petition for review, seeking an increase in discipline. The Board conducted review proceedings and, on May 11, 2011, the Board issued its order increasing discipline from a reprimand to a 30 day suspension of respondent's license to practice law in Michigan, effective June 9, 2011.

On June 7,2011, the Grievance Administrator filed an Application for Leave to Appeal with the Michigan Supreme Court. Pursuant to the Board's order, the Attorney Discipline Board issued a Notice of Suspension [Pending Appeal] on June 9, 2011.

Respondent filed a Cross-Application for Leave to Appeal with the Michigan Supreme Court on June 13,2011, in accordance with MCR 7.302(0 )(2) Pursuant to MCR 9.124(C), respondent's suspension was automatically stayed and the Board's notice, issued June 9, 2011, is hereby vacated, nunc pro tunc, and respondent's license to practice law remains active, without interruption.
