NOTICE OF REPRIMAND AND RESTITUTION (On Remand)

Case No. 09-15-GA Notice Issued: April 26, 2011

Frederick L. McDonald, P 17366, Ann Arbor, Michigan, by the Attorney Discipline Board Washtenaw County Hearing Panel #5.

1. Reprimand 2. Effective April 26, 2011 The respondent filed an answer to the formal complaint and appeared at the hearing. The panel found that respondent had not committed professional misconduct and dismissed the formal complaint.

The Grievance Administrator filed a petition for review and the Attorney Discipline Board, after conducting review proceedings, found that respondent had committed professional misconduct when he failed to determine whether or not his client's appeal was timely filed; failed to monitor the . status of the appeal; and failed to communicate in a meaningful way with his client about the appeal, in violation of Michigan Rules of Professional Conduct 1.3; 1.4(a) and (b). The Board issued an order vacating the hearing panel's order of dismissal and remanding the matter to the panel for a hearing on discipline.

After conducting a discipline hearing on February 3, 2011, the hearing panel issued an order reprimanding respondent and ordering him to pay restitution in the amount of $1,000.00. Total costs were assessed in the amount of $2,899.21.
