1. Dismissal 2. Effective March 19,2011 Respondent was alleged to have committed professional misconduct in a contested probate matter by allegedly signing and filing a petition for surcharge and other damages and relief in the probate matter which was frivolous, in violation of MCR 9.104(A)(1}, {2} and {4}; and Michigan Rules of Professional Conduct 3.1.

AtĀ· the conclusion of all testimony and proofs, respondent filed a motion to dismiss the matter, which was granted by the panel. The panel stated that, given the specific facts of the case, the Grievance Administrator had not established, by a preponderance of the evidence, that respondent's allegations in the petition for surcharge were not made in good faith. No costs were assessed against respondent.
