NOTICE OF SUSPENSION AND RESTITUTION Case No. 10-136-GA Notice Issued: March 30, 2011

Kenneth A. Skuzenski, P 33962, Mt. Clemens, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #106.

1. Suspension - 180 Days 2. Effective March 30, 2011 Respondent did not appear at the hearing and was found to be in default for failing to file an answer to the formal complaint. Based on respondent's default, the panel found that respondent, after being retained in four matters, failed to perform the services for which he was retained; did not return phone calls; did not advise his clients as to the status of their matters; and failed to refund unearned fees. Additionally, respondent was found to have engaged in joint representation of clients in a matter in which the clients' interests were directly adverse; and engaged in representation of a client where the client's interests may be materially limited by the lawyer's responsibilities to another client. Finally, respondent was found to have knowingly failed to respond to a lawful demand for information from a disciplinary authority; and failed to answer three requests for investigation served upon him by the Grievance Administrator.

Respondent's conduct was in violation of MCR 9.104(A)(2)-(4) and (7); MCR 9.113(A) and (B)(2); and Michigan Rules of Professional Conduct 1.1 (c); 1.2(a); 1.3; 1.4(a); 1.7(a) and (b); 1.16(d); 8.1 (a)(2); and 8.4(a) and (c).

The panel ordered that respondent's license to practice law in Michigan be suspended for 180 days and that he pay restitution in the aggregate amount of $3,450.00. Costs were assessed in the amount of $1 ,790.77.
