NOTICE OF REPRIMAND AND RESTITUTION (By Consent)

Case No. 11-14-GA Notice Issued: March 30, 2011 Neil S. Rockind, P 48618, Southfield, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #72.

1. Reprimand 2. Effective March 30, 2011 The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline in accordance with MCR 9.115(f)(5) which was approved by the Attorney Grievance Commission and accepted by the hearing panel. Respondent pleaded nolo contendere to the allegations that he neglected a legal matter; failed to keep his client reasonably informed about the status of his matter and complying promptly with reasonable requests for information; failed, as the supervisory lawyer, to make reasonable efforts to ensure that the other lawyer conforms to the Rules of Professional Conduct; and failed, as the supervisory lawyer, to make reasonable efforts to ensure that the non-lawyer's conduct is compatible with the professional obligations of the lawyer.

Respondent's conduct was alleged to be in violation of MCR 9.1 04(A)(1 )-(4); and Michigan Rules of Professional Conduct 1.1 (c); 1.4(a); 5.1 (b); 5.3(b); and 8.4(a) and (c).

Based upon the stipulation of the parties, the hearing panel ordered that respondent be reprimanded and that he pay restitution in the amount of $32,500.00. Costs were assessed in the amount of $823.49.
