Effective September 17, 20101 The hearing panel found that respondent, in a bankruptcy matter, failed to provide competent representation to his client; failed to seek the lawful objectives of his client; failed to act with reasonable diligence and promptness in representing his client; failed to keep his client reasonably informed about the status of the matter; failed to explain the matter to the extent reasonably necessary to permit his client to make informed decisions regarding the representation; failed to deposit legal fees and expenses paid in advance into a client trust account until earned; failed to refund any advance payment of fee that has not been earned; and failed to answer a request for investigation in conformity with MCR 9_113.
Respondent's conduct was in violation of MCR 9.1 04(A)(1 )-(4) and (7); and Michigan Rules of Professional Conduct 1.1(a); 1.2(a); 1.3; 1.4(b); 1.15(g); 1.16(d); and 8.4(a) and (c).
The panel ordered that respondent's license to practice law be suspended for 180 days and that he pay restitution in the aggregate amount of $2,174.00. Total costs were assessed in the amount of $2,718.13.
