NOTICE OF REPRIMAND AND RESTITUTION WITH CONDITIONS (By Consent)

Case No. 09-33-GA Notice Issued: August 24,2010 David K. Wenger, II, P 23078, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #24.

1. Reprimand 2. Effective August 18, 2010 The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline, in accordance with MCR 9.11S(F)(S), which was approved by the Attorney Grievance Commission and accepted by the hearing panel. The stipulation contains respondent's plea of no contest to the allegation that he failed to timely answer three requests for investigation served upon him by the Grievance Administrator.

Respondent's conduct was alleged to be in violation of Michigan Court Rules 9. 10 4(A)(7) and 9.113(A) and (B)(3).

Based upon the stipulation of the parties, the hearing panel ordered that respondent be reprimanded and pay restitution in the amount of $2,000.00. Respondent was also ordered to be subject to conditions relevant to the alleged misconduct. Costs were assessed in the amount of $933.77.
