DISMISSAL Case No. 10-10-RD William A. Garrett, P 13859, Temperance, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #5.

1. Dismissal 2. Effective June 12, 2010 The Grievance Administrator filed a petition for order to show cause for reciprocal discipline based on the interim remedial suspension of respondent's license to practice law in Ohio. Respondent filed an objection to the order to show cause, and the Attorney Discipline Board requested additional briefings on the issue.

The Board noted an Ohio hearing panel had not yet determined by clear and convincing evidence that respondent has engaged in misconduct. The Board concluded that "it does not appear from petitioner's filings that respondent has been the subject of 'an adjudication of misconduct in a disciplinary proceeding by another state,'" as defined in MCR 9.1 04(B).

The Board dismissed the Grievance Administrator's petition, with prejudice, noting that the Grievance Administrator may file another petition for order to show cause should respondent become the sub' ect of an adjudication of misconduct. No costs were assessed against respondent.
