NOTICE OF REPRIMAND Case No. 09-18-GA Notice Issued: June 2, 2010 Jeffrey M. Gagie, P 49822, Paw Paw, Michigan, by the Attorney Discipline Board Kalamazoo County Hearing Panel #4.
1. Reprimand 2. Effective June 2,2010 Based on respondent's plea of no contest to the allegations in the formal complaint, the hearing panel found that respondent, in a divorce matter, failed to provide competent representation to a client; failed to abide by a client's decision to accept an offer of settlement; failed to keep a client reasonably informed about the status of a matter and comply with reasonable requests for information; failed to explain a matter to the extent reasonably necessary to permit the client to make informed decisions regarding the representation; and failed to refund an unearned retainer.
Respondent's conduct was found to be in violation of MCR 9.104(A)(1 )-(4); and Michigan Rules of Professional Conduct 1.1; 1.2(a); 1.4(a) and (b); 1.16(d); and 8.4(a) and (c).
The panel ordered that respondent be reprimanded and assessed costs in the amount of $2,127.75.
