1. Revocation 2. Effective April 15, 2010 The respondent did not appear at the hearing and was found to be in default for his failure to file an answer to the formal complaint. Based on that default, the panel found that respondent neglected a legal matter entrusted to him; collected a clearly excessive fee; failed to hold the property of clients in connection with a representation separate from the lawyer's own property; withdrew unearned legal fees from his client trust account and deposited such funds with his own; failed to refund unearned fees upon the termination of his representation; misappropriated client funds; and failed to answer a request for investigation.
Respondent's conduct was in violation of MCR 9.1 04(A)(1 )-(4) and (7); MCR 9.113(A) and (B)(2); and Michigan Rules of Professional Conduct 1.1 (c); 1.5; 1.15(d) and (g); 1.16(d); 8.4(a)-(c);
The hearing panel ordered that respondent's license to practice law in Michigan be revoked and that he pay restitution in the amount of $22,530.00. Costs were assessed in the amount of $1,982.53.
