NOTICE OF REPRIMAND AND RESTITUTION (By Consent)

Case No. 09-54-GA Notice Issued: May 19, 2010 Paul J. Pemberton, P 18760, Beaverton, Michigan, by the Attorney Discipline Board Tri-Valley Hearing Panel #2.

1. Reprimand 2. Effective May 19, 2010 Based on the panel's findings of professional misconduct, the respondent and the Grievance Administrator filed a stipulation for a consent order regarding discipline, in accordance with MCR 9.115(F)(5), which was approved by the Attorney Grievance Commission and accepted by the hearing panel.

The panel found that respondent's conduct in various criminal matters for a client were prejudicial to the administration of justice; contrary to justice, ethics, honesty or good morals; and involved dishonesty, fraud, deceit, or misrepresentation, or violation of the criminal law, where such conduct reflects adversely on the lawyer's honesty, trustworthiness, or fitness as a lawyer, in violation of MCR 9.104(A)(1) and (3); and Michigan Rules of Professional Conduct 8.4(b) and (c) ..

Based upon the stipulation of the parties, the hearing panel ordered that respondent be reprimanded and pay restitution in the amount of $1 ,800.00. Costs were assessed in the amount of $1 ,676.56.
