NOTICE OF SUSPENSION WITH CONDITION (By Consent)
Case No. 20-16-GA Notice Issued: February 16, 2021 C. Clifford Chadwick, P 34372, Sylvan Lake, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #70.
Suspension - 30 Days, Effective February 12, 2021 The respondent and the Grievance Administrator filed a Stipulation for Consent Order of Discipline, in accordance with MCR 9.115(F)(5), which was approved by the Attorney Grievance Commission and accepted by the hearing panel. The stipulation contained respondent’s admissions to the allegations that he committed acts of professional misconduct in his representation of a defendant in a breach of mortgage covenant matter filed in the Oakland County Circuit Court.
Based on respondent’s admissions and the stipulation of the parties, the panel found that respondent neglected a legal matter entrusted to him, in violation of MRPC 1.1(c); failed to seek the lawful objectives of his client through reasonably available means, in violation of MRPC 1.2(a); failed to act with reasonable diligence and promptness in representing his client, in violation of MRPC 1.3; and brought or defended a frivolous proceeding, or asserted or controverted a frivolous issue therein, in violation of MRPC 3.1. Respondent was also found to have violated MCR 9.104(1)-(3).
In accordance with the stipulation of the parties, the hearing panel ordered that respondent’s license to practice law in Michigan be suspended for 30 days. In addition, respondent was ordered to either provide written verification of his attendance at the November 2020 State Bar of Michigan’s seminar entitled “Tips and Tools” for a Successful Practice, or attend the next scheduled seminar. Costs were assessed in the amount of $942.30.
