FINAL NOTICE OF SUSPENSION Case No. 11-82-MZ* (Ref. 10-99-MZ; 09-57 -GA) Notice Issued: July 28, 2011

James M. Wickenheiser, P 45483, Detroit, Michigan, by the Attorney Discipline Board. 1. Suspension - 180 Days 2. Effective December 29, 20091 In Grievance Administrator v James M. Wickenheiser, Case No. 09-57-GA, respondent failed to appear at the hearing and was found to be in default for failing to file an answer to the formal complaint. Based on that default, the hearing panel found that respondent failed to answer a request for investigation, served upon him by the Grievance Administrator, in violation of MCR 9.1 04(A)(1), (2) and (7); MCR 9.113; and Michigan Rules of Professional Conduct 8.1 (a)(2); and

8.4(a) and (c). The panel ordered that respondent's license to practice law in Michigan be suspended for 180 days.

Respondent filed a delayed petition for review, which was granted by the Attorney Discipline Board. Upon review, the Board issued an order reducing respondent's suspension from 180 days to 179 days and imposed conditions relevant to the established misconduct. On March 14, 2011, the Grievance Administrator filed a Motion to Increase Discipline based on respondent's failure to comply with the conditions imposed in the Board's order reducing suspension from 180 days to 179

days.

The Board issued an order to show cause and respondent did not file a response. As a result, on June 17,2011, the Board issued an order vacating its December 21,2010 order and reinstating Tri-County Hearing Panel #16's order suspending respondent's license to practice law

in Michigan for 180 days, effective December 29, 2009.
