In Grievance Administrator v James M. Wickenheiser, Case No. 09-57 -GA, respondent failed to appear at the hearing and was found to be in default for failing to file an answer to the formal complaint. Based on that default, the hearing panel found that respondent failed to answer a request for investigation, served upon him by the Grievance Administrator, in violation of MCR 9.104(A)(1), (2) and (7); MCR 9.113; and Michigan Rules of Professional Conduct 8.1 (a)(2); and 8.4(a) and (c). The panel ordered that respondent's license to practice law in Michigan be suspended for 180 days.

Respondent filed a delayed petition for review, which was granted by the Attorney Discipline Board. Upon review, the Board issued an order reducing respondent's suspension from 180 days to 179 days and imposed conditions relevant to the established misconduct.

Total costs were assessed in the amount of $1 ,781.98, which includes $1,676.73 in costs assessed in Grievance Administrator v James M. Wickenheiser, Case No. 09-57-GA.
