NOTICE OF SUSPENSION AND RESTITUTION WITH CONDITIONS (Pending Appeal)

Case No. 09-56-GA Notice Issued: January 8, 2010 Gregory A. Mikat, P 55735, Fenton, Michigan, by the Attorney Discipline Board Genesee County Hearing Panel #3_

1. Suspension - 179 Days 2_ Effective January 6,2010 The panel found, based on respondent's stipulation, that he committed professional misconduct by failing to seek the reasonable objectives of a client within the bounds of the law; engaging in conflict of interest; failing to protect the client's interests upon withdrawal by not refunding the fee; communicating with an opposing party represented by counsel without authorization; and by making a material omission to his client when he failed to disclose that he was having a sexual relations with his client's wife, at the time his client was seeking legal advice concerning the affair.

Respondent's conduct was in violation MCR 9.104(A)(1 )-(3); and Michigan Rules of Professional Conduct 1.2(a); 1.7(b); 1.16(d); 4.2; and B.4(c).

The panel ordered the respondent's license to practice law in Michigan be suspended for 179 days and that he pay restitution in the amount of $1,500.00. The panel also ordered that respondent shall be subject to conditions relevant to the admitted misconduct.

The Grievance Administrator filed a petition for review seeking increased discipline. The matter will be scheduled for hearing before the Attorney Discipline Board.
