NOTICE OF SUSPENSION WITH CONDITIONS (By Consent)

Case No. 09-69-GA Notice Issued: January 5, 2010 Noel l. Lippman, P 16719, Almont, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #53.

1. Suspension - 5 Years 2. Effective January 5, 2010 The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline in accordance with MCR 9.115(F)(5) which was approved by the Attorney Grievance Commission and accepted by the hearing panel. Respondent pled no contest to the allegations that, in seven separate matters, he committed professional misconduct when he practiced while suspended; held himself out as an attorney by any means while suspended; and shared in legal fees for legal services performed by another during his suspension. In six of those matters, respondent was alleged to have engaged in the unauthorized practice of law; and in one matter, he was alleged to have failed to sever his employment with, and financial interests in, professional limited liability companies, in violation of MCl 450.4906; MCR 9.1 04(A)(2)-(4); MCR 9.11 9(E)(1) and (3); MCR 9.119(F); and Michigan Rules of Professional Conduct 5.5(a); and 8.4(a) and (b).

Based upon the stipulation of the parties, the hearing panel ordered that respondent's license to practice law in Michigan be suspended for five years and that he be subject to certain conditions related to the alleged misconduct. Costs were assessed in the amount of $1 ,218.10.
