NOTICE OF REPRIMAND (By Consent)
Case No. 06-7-GA Notice Issued: August 25,2009 Noel L. Lippman, P 16719, Almont, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #101.
1. Reprimand 2. Effective August 21,2009 1 On February 2,2007, Tri-County Hearing Panel #101 entered an order of dismissal on the grounds that misconduct had not been established. Following review proceedings conducted in accordance with MCR 9.118, the Attorney Discipline Board concluded that respondent's knowing failure to respond to a lawful demand for information from the Grievance Administrator constituted a violation of MRPC 8.1 (A)(2). The matter was remanded to the panel for a hearing on discipline as to that misconduct and for reconsideration of the hearing panel's dismissal of charges under MRPC 1.1 (B) and (C). On remand, the hearing panel reaffirmed its decision that respondent's conduct did not violate MRPC 1.1 (8) and (C).
On April 2, 2009, the Grievance Administrator and the respondent submitted a stipulation for a consent order of discipline pursuant to MCR 9.115(F)(5) containing the parties agreement that respondent should be reprimanded for his violation of MRPC 8.1 (A)(2). The stipulation was approved by the Attorney Grievance Commission and accepted by the hearing panel.
Costs were assessed in the amount of $3,780.73.
