NOTICE OF SUSPENSION Case No. 08-10-MZ (Ref. 06-156-GA) Notice Issued: October 8,2008

David L. Rosenthal, P 24758, Bloomfield Hills, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #51.

1. Suspension - 6 Months 2. Effective April 28, 2009 1 The Grievance Administrator filed a petition for order to show cause on January 25, 2008 seeking additional discipline for respondent's failure to comply with the hearing panel's October 5, 2007 order. Specifically, the Grievance Administrator alleged that respondent, while suspended from the practice of law in Michigan, continued to hold himself out as an attorney; appeared in court; contacted opposing counsel; gave legal advice; failed to pay the restitution and costs which

were ordered; and failed to notify the courts, his client and opposing counsel of his suspension as required by MCR 9.119.

Based upon the evidence presented at the show cause hearing, the panel concluded that respondent, while suspended, continued to hold himself out as an attorney; appeared in court;

contacted opposing counsel; gave legal advice; and failed to pay the restitution and costs which were ordered; and failed to notify the courts, his client and opposing counsel of his suspension as

required by MCR 9.119.

The panel ordered that respondent be suspended for an additional six months, to run consecutively with the 180 day suspension then in effect in Grievance Administrator v David L. Rosenthal, ADB Case No. 06-156-GA. Total costs were assessed in the amount of $2,244.82.

1 Respondent has been continuously suspended from the practice of law in Michigan since October 27,2007. See Notice of Suspension and Restitution With Conditions (Pending Appeal) which was issued November 5, 2007. In an order entered September 17, 2008, the Attorney Discipline Board increased discipline in that case from a suspension of 180 days to revocation of respondent's

license, effective October 27,2007.
