NOTICE OF SUSPENSION WITH CONDITION (By Consent)

Case No. 08-122-GA Notice Issued: July 9, 2009 Marvin L. Berris, P 10751, Bingham Farms, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #53.

1. Suspension - 60 Days 2. Effective August 1, 2009 The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline, in accordance with MCR 9.115(F)(5), which was approved by the Attorney Grievance Commission and accepted by the hearing panel. Respondent pled no contest to the allegations that he neglected ? legal mater entrusted to him; failed to act with reasonable promptness and diligence in representing a client; failed to keep a client reasonably informed about the status of his matter; failed to comply with reasonable requests for information; and failed to explain a matter to a client to the extent necessary to permit the client to make informed decisions regarding the representation, in violation of MCR 9.014(A)(1 )-(4); and Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.4(a)-(b); and 8.4(a) and (c).

Pursuant to the agreement of the parties, the hearing panel ordered that respondent's license to practice law in Michigan be suspended for 60 days, effective August 1, 2009. The panel also ordered that respondent be subject to a condition relevant to the alleged misconduct. Costs were assessed in the amount of $972.28.
